Please read these terms of service carefully before using this website or purchasing our products.

These terms apply to your use of this website and all of the sites and services owned or operated by The Akkeri including but not limited to: theakkeri.com. These terms also apply when you purchase any of our products or services on this Site including courses and coaching (collectively, our “Products”). By accessing or using our Site or purchasing any Products, you agree to be bound by and to follow these terms.

We reserve the right to modify these terms at any time, so please check this page periodically for changes.

By using our Site or ordering Products after we post any changes to these terms, you agree to accept those changes, whether or not you have reviewed them or been notified about them. If at any time you choose not to accept these terms, please do not use this Site or any of our Sites.

Payments for Online Purchases

Payment for your online purchases will be made via credit card or Paypal as specified at the point of payment. By placing an order with us, you agree that we may charge your account the full purchase price, including all fees for shipping and all applicable taxes immediately or, if you have elected an optional payment plan, in accordance with the payment plan schedule provided at the point of purchase.  All prices and other dollar amounts are listed in USD.

By placing an order with us, you represent and warrant that the credit card or payment account being used is yours, and/or that you are duly authorized to use the account, and you agree to indemnify and hold harmless The Akkeri and each of its officers, directors, employees, contractors, coaches, representatives, agents, successors and assigns each a “Company Releasee” and collectively, the “Company Releasees” from any and all damages or losses of any nature or kind, including attorneys’ fees, that any Company Releasee may incur arising from any breach of or inaccuracy in the foregoing representation and warranty.

Every effort has been made to ensure the accuracy of prices, items, and availability of Products available through our Sites; however, typographical or clerical errors do occur. Accordingly, we reserve the right to revoke any stated price and to correct any errors, inaccuracies or omissions including after an order has been submitted and whether or not the order has been confirmed and your payment method charged. If your payment method has already been charged for the purchase and your order is cancelled, we will issue a credit or charge to your account in the amount of the charge. Images of Products on the Sites are for illustrative purposes only; actual Products may differ from such images.

We will email you to confirm the placement of your order and with details concerning product or service delivery. In the event that there is an error in this email confirmation or with course emails, it is your responsibility to inform us as soon as possible.

Cancellations and Refunds

You have the right to cancel your order or access to our Products at any time. Refunds will be granted on a per-case basis.

For our Courses, refunds may be granted only if Course content has not yet been accessed. For our Coaching, refunds may only be granted for unused sessions. If a session is canceled with less than 24 hours’ notice, a fee may be charged. If sessions are repeatedly canceled with less than 24 hours’ notice, we may choose to cancel any remaining sessions in a Coaching package.

Intellectual Property

All materials used in our Products are the intellectual property of The Akkeri. You cannot share, copy, or create derivative works or resource guides that reference The Akkeri or infringe on the company’s intellectual property in any way. Company images, logos, and content are protected by trademark. You are granted no right or license to the aforementioned trademarks.

Non-disparagement

You agree that you will not engage in any conduct or communications with a 3rd party, public or private, designed to disparage The Akkeri including, but not limited to, any remark, comment, message, information, declaration, campaign, communication or other statement of any kind being verbal, in writing, electronic or otherwise that might be construed as derogatory, defamatory, libelous, or slander.

Finally, we reserve to the right to cancel your access to our Products and withhold a refund, for any reason. For example: we may withhold a refund if you share confidential material from our Products or conduct communications to disparage The Akkeri.

Liability

You agree that under no circumstances shall we be liable for direct, indirect, incidental, consequential, special, punitive, exemplary, or any other damages arising out of your use of the Site or our Products. Additionally, The Akkeri is not liable for damages in connection with (i) any failure of performance, error, omission, denial of service, attack, interruption, deletion, defect, delay in operation or transmission, computer virus or line or system failure: (ii) loss of revenue, anticipated profits, business savings, goodwill or data; and (iii) their party theft of, destruction of, unauthorized access to, alteration of, or use of your information or property, regardless of our negligence, gross negligence, failure of an essential purpose and whether such liability arises in negligence, contract, tort, or any other theory of legal liability.

The foregoing applies even if The Akkeri has been advised of the possibility of or could have foreseen the damages. In those states that do not allow the exclusion or limitation of liability for the damages, our liability is limited to the fullest possible extent permitted by law. In no event shall The Akkeri’s cumulative liability to you exceed the total purchase price of the Products you have purchased from us, and if no purchase has been made by you The Akkeri’s cumulative liability to you shall not exceed $100.

Overall Intellectual property

All content provided on the Site and in the Products are the intellectual property of The Akkeri and are provided to our clients for their learning and not for commercial use. The content of the Site and Products are protected by copyright law. You may not modify, publish, transmit, participate in the transfer or sale of, create derivative works from, distribute, display, reproduce or perform, or in any way exploit in any format whatsoever any of the content of the Site or the Products, in whole or in part without our prior written consent. You may not remove any trademark, copyright, or other notice from the content of the Site or the Products. We reserve the right to immediately remove you from the Products without refund and pursue all available legal remedies against you if you are caught violating this intellectual property policy.

DISCLAIMER

Every effort has been made to accurately represent our Products and their potential, and every effort is made to ensure that those who purchase our Products achieve the outcomes that they have in mind.

There is no guarantee that our Products will provide the outcomes described in the Products description or those that you have in mind.

The outcomes you experience from our Products depend upon the work that you put into studying, practicing, and implementing what you learn.

The Akkeri is not liable for any outcomes related to or spurring from its Products that you are unhappy with nor are we responsible for any of your actions.

There is no guarantee that you will earn any money using the techniques and ideas in these materials. Examples in these materials are not to be interpreted as a promise or guarantee of earnings. Earning potential is entirely dependent on the person using our product, ideas and techniques. We do not position this product as a “get rich scheme.”

Your level of success in attaining the results claimed in our materials depends on the time you devote to the program, ideas and techniques mentioned, your finances, knowledge and various skills.
